Terms of service

The agreement between your business and LinxAI (Pty) Ltd for the use of Stubie. Written to be read once, by an owner, without a lawyer in the room.

By using Stubie you agree to what follows. If you are signing on behalf of a business, you confirm you are allowed to bind it. “We” and “LinxAI” mean LinxAI (Pty) Ltd; “you” means your business.

1. What Stubie does

Stubie reads the enquiries that arrive on the WhatsApp number and email address you connect, prices them against the price list you provide, and drafts quotes for you to approve. Once you approve, it sends the quote, hosts the quote page, issues a payment reference and chases payment on the schedule you set.

Stubie is a tool for your business. It is not a bank, a payment processor, an accountant or a legal adviser, and it does not give advice on what you should charge.

2. Your account

Access is invite-only while we set up price lists by hand. You are responsible for keeping sign-in details private and for everything done under your account, including approvals made by your staff.

You must have the right to use the WhatsApp number and email address you connect, and you must comply with the rules of those platforms.

3. Approval and accuracy

Nothing goes to a customer without your approval. A quote you approve is your quote: your prices, your name, your commitment to the customer.

Stubie prices from the list you give us. It flags anything it cannot price rather than guessing. Keeping that list current is your responsibility, and we are not liable for a quote sent at a price you approved.

4. Fees and billing

Fees are those set out on the pricing page or in your order form. Build & Run is R 5 500 per month with a once-off setup fee of R 8 750. All-inclusive is R 6 999 per month with no setup fee on a twelve-month term. Amounts are quoted excluding VAT unless stated otherwise.

Usage past the monthly volumes is billed at R 12 per conversation and R 2,20 per notification. Invoices are issued monthly in advance and are payable within seven days.

We may change fees on 60 days written notice. If you do not accept a change, you may cancel before it takes effect.

5. Term and cancellation

Build & Run runs month to month and either side may end it on 30 days written notice. All-inclusive runs for twelve months, then month to month on the same notice.

We may suspend the service if an invoice is more than 30 days overdue, or immediately if the service is being used unlawfully. On termination we give you an export of your quotes, orders and price list.

6. Customer payments

Your customers pay you by EFT into your own bank account, against a reference Stubie issues. Stubie never receives, holds or routes your money, and takes no percentage of your orders.

Reminders are sent inside working hours on the schedule you approve. Whether a payment has reflected, and whether to release an order, remains your call.

7. Your data

Your price list, your quotes, your orders and your customer records belong to you. We process them as your operator under POPIA and only to run the service, as set out in the privacy policy.

We do not use your customers’ messages to train models, and we do not sell your data.

8. Availability

We aim for 99,5% monthly availability, excluding scheduled maintenance, which we give notice of. Stubie depends on WhatsApp, email and network providers we do not control; an outage on their side is not an outage we can promise against.

Enquiries that arrive during an outage are not lost — they queue and are processed when service resumes.

9. Liability

The service is provided as it stands. To the extent the law allows, neither side is liable to the other for indirect or consequential loss, including lost profit or lost business.

Our total liability in any twelve-month period is limited to the fees you paid us in that period. Nothing here limits liability for fraud, gross negligence, or anything the Consumer Protection Act does not permit us to limit.

10. General

This agreement is governed by South African law and the courts of South Africa have jurisdiction. If a clause is unenforceable, the rest stands. We may update these terms on 30 days notice; continued use after that means you accept the update.
